1. About this policy
NxtCar Pty Ltd (“NxtCar”, “we”, “us”) is committed to protecting your privacy. This policy explains how we collect, hold, use and disclose personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs).
2. What we collect
We collect personal information reasonably necessary to provide our accident replacement vehicle service, including:
- Identity and contact details — name, phone, email, address, date of birth;
- Driver licence details, for verification and the hire agreement;
- Vehicle and insurance details — your car, your insurer (if any), your claim number;
- Accident details — date, location, circumstances, photos, dashcam footage, witness details, and the at-fault party’s details;
- Repair information from you or your repairer;
- Website usage data (see “Cookies and analytics” below).
3. How we collect it
Usually directly from you — by phone, our website forms, or in person at vehicle delivery. We may also collect information from your repairer, your insurer, the at-fault party’s insurer, or other parties involved in the accident where reasonably necessary to provide the service or recover hire charges.
4. Why we collect, use and hold it
- To assess your eligibility for a replacement vehicle;
- To prepare and administer your hire agreement;
- To deliver, manage and collect the hire vehicle;
- To recover hire charges from the at-fault party and/or their insurer, including through legal processes where necessary;
- To respond to enquiries and complaints;
- To meet our legal obligations;
- With your consent, to send you service updates about your hire.
We do not sell your personal information. We will not use it for unrelated marketing without your consent, and any marketing we send will include a working unsubscribe option in line with the Spam Act 2003 (Cth).
5. Who we disclose it to
- The at-fault party’s insurer (and their agents), for cost recovery;
- Your repairer, to coordinate hire duration with repair timelines;
- Our professional advisers, including lawyers handling recovery;
- Service providers who support our business (e.g. IT and hosting providers), under confidentiality obligations;
- Courts, regulators or law enforcement where required by law.
Some service providers may store data on servers located overseas. Where that occurs, we take reasonable steps to ensure the information is handled consistently with the APPs.
6. Storage and security
We hold personal information in secure, access-controlled systems and take reasonable steps to protect it from misuse, interference, loss and unauthorised access, modification or disclosure. We retain information only as long as needed for the purposes above or as required by law, then destroy or de-identify it.
7. Cookies and analytics
Our website uses only essential cookies and privacy-respecting analytics necessary to operate and improve the site. We do not use third-party advertising trackers. You can control cookies through your browser settings.
8. Access and correction
You may request access to, or correction of, the personal information we hold about you at any time by contacting us (details below). We will respond within a reasonable period and will not charge for making a request.
9. Complaints
If you believe we have breached the APPs, contact us first and we will investigate and respond within 30 days. If you are not satisfied with our response, you can complain to the Office of the Australian Information Commissioner (OAIC) at oaic.gov.au or 1300 363 992.
